TERMS OF SALE
These Terms of Sale, set out the terms under which hand-made Ceramic artworks are sold by me to consumers through this website www.lisakrigel.com (LKC, my, our, we) Please read these Terms of Sale carefully and ensure that you understand them before ordering any products from LKC. You will be required to read and accept these Terms of Sale when ordering products. If you do not agree to comply with and be bound by these Terms of Sale, you will not be able to order products through my site. These Terms of Sale, as well as any and all Contracts are in the English language only.
Information about me
is owned and operated by Lisa Krigel, sole owner of Lisa Krigel Ceramics, whose registered address is at Fireworks Clay Studios, 24 Tudor Lane, Cardiff CF11 6AZ. I am not VAT registered.
ACCESS TO AND USE OF MY SITE
Payment for all orders is at point of sale and not at point of despatch. Payment is made using our online payment facility and you can pay by credit / debit card or you can use PayPal. We can also take payments by Bank Transfer, please email or telephone before ordering online.
By entering card details onto our system you confirm that the credit or debit card being used is yours. All credit / debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery. We reserve the right to reject any offer of purchase by anyone at any time.
Estimated delivery times are given for each product, on each product page. Please check these carefully. I will work very hard to meet the delivery times quoted on my site and aim to be as quick as possible, especially if something is needed for a gift. Please bear in mind that delivery times are estimates.
If you need something by a given date please contact us via email or telephone and we will do our best to help you.
Unfortunately we cannot fulfil any obligations
· if the product you ordered becomes out of stock
· if we are unable to fulfil your order due to circumstances beyond reasonable control
· if we are unable to obtain authorisation for your payment
· or if we identify a pricing or product description error
Delivery & Shipping
All UK orders are delivered using Royal Mails first class services including Parcelforce Worldwide and your order will always be tracked. On dispatch you will receive confirmation email. We aim to deliver UK orders within 2-5 days.
International Delivery & Shipping
If you are outside the UK and you’re interested in ordering something, please get in touch with your full name and address to email@example.com and I will be happy to arrange this with you including a bespoke shipping quote.
All deliveries to customers outside of the United Kingdom are made via Royal Mail / ParcelForce International, and your orders will always be tracked. I aim to deliver international parcels between 5-10 days, however there may be delays due to Brexit and other conditions that may be out of my control. You will however be responsible for any customs duties. Every country has different regulations, so please check before ordering.
Lisa Krigel will not be held responsible for unexpected customs charges.
Please make sure the delivery address is accurate to guarantee a successful delivery.
All international shipping costs are calculated by volumetric weight and size.
Please understand that you are buying artwork so please make your choices carefully. However, If you change your mind you’re entitled to cancel your order, provided you do so no longer than 7 days after the day on which you receive the products. You’ll be given a full refund, including the initial postage charge. Please note that this does NOT apply to bespoke or commissioned pieces.
Please email me with your contact and order details and let me know why you are returning an item before sending that item back. Once I have received your email, I will contact you confirming that your return is eligible. Items must be in the original undamaged packaging and shipped back to my studio at your expense. I will refund the full cost of the item when it safely reaches the studio. It must arrive back in the same condition as it was received. The return will be issued to the original source of payment excluding shipping costs within 7 - 10 days.
If your item arrives damaged please let me know within 48hrs of arrival by sending a photo of the item and packaging by emailing: firstname.lastname@example.org
If you return goods to us, please use an insured method of despatch and obtain proof of posting. We can’t accept liability for returned goods being lost or damaged in transit.
PRODUCT PRICING AND DESCRIPTION
All prices are in pounds sterling. Each product purchased is sold subject to its Product Description, but please remember that handmade ceramics are not mass-produced and therefore slight variations in design/ colour/ size are always possible.
I make all reasonable efforts to ensure that all descriptions and photographic representations of my work available from my shop correspond to the actual product. Please note, however, the following:
Images are for illustrative purposes only. There may be slight variations in colour between the image of a product and the actual product sold due to differences in computer displays and lighting conditions. I am happy to meet you remotely at my studio via FaceTme or Zoom if you’d like a closer look before purchasing. If you are interested in doing this, please contact email@example.com to make an appointment.
Please also remember that these are hand-made pieces and that clay moves during the drying and firing stages, so when you order a multiple-pieces, the colour of the clay and glaze might be slightly different shades. This is due to the location of the individual piece in the kiln. The variation is not dramatic and differences always add character to a handmade product and absolutely does not have an effect on the function. As above, I am always happy to meet you remotely by contacting me, firstname.lastname@example.org for a FaceTime or Zoom appointment if you’d like a closer look before purchasing.
I check all prices before I accept your order, but in the unlikely event that I have shown incorrect pricing information, I will contact you in writing to inform you of the mistake. If the correct price is lower than that shown when you made your order, I will simply charge you the lower amount and continue processing your order. If the correct price is higher, I will give you the option to purchase the Goods at the correct price or to cancel your order (or the affected part of it). I will not proceed with processing your order in this case until you respond. If I do not receive a response from you within 5 working days, I will treat your order as cancelled and notify you of this in writing.
In the event that the price of you have ordered changes between your order being placed and Me processing that order and taking payment, you will be charged the price shown on my site at the time of placing your order.
Delivery charges are not included in the product price displayed on my site. Delivery costs will be presented to you as part of the order process.
EVENTS OUTSIDE OF OUR CONTROL (FORCE MAJEURE)
I will not be liable for any failure or delay in performing My obligations where that failure or delay results from any cause that is beyond My reasonable control. Such causes include, but are not limited to: power failure, internet service provider failure, strikes, lock-outs or other industrial action by third parties, riots and other civil unrest, fire, explosion, flood, storms, earthquakes, subsidence, acts of terrorism (threatened or actual), acts of war (declared, undeclared, threatened, actual or preparations for war), epidemic or other natural disaster, or any other event that is beyond My reasonable control.
If any event occurs that is likely to adversely affect My performance of any of My obligations under these Terms of Sale:
I will inform you as soon as is reasonably possible;
I will take all reasonable steps to minimise the delay;
To the extent that I cannot minimise the delay, My affected obligations under these Terms of Sale (and therefore the Contract) will be suspended and any time limits that I am bound by will be extended accordingly;
I will inform you when the event outside of My control is over and provide details of any new dates, times or availability of Goods as necessary;
If the event outside of My control continues for more than 14 calendar days I will cancel the Contract and inform you of the cancellation. Any refunds due to you as a result of that cancellation will be paid to you as soon as is reasonably possible and in any event within 14 calendar days of the date on which the Contract is cancelled;
If an event outside of My control occurs and continues for more than 14 calendar days and you wish to cancel the Contract as a result, you may do so in any way you wish.
